TERMS AND CONDITIONS
Please read this Agreement carefully. It governs your registration and participation in any programs, services, memberships, courses, or access to the members’ portal (“Program,” “Membership,” or “Service”) offered by The Centre for Digestive Health (“Company,” “we,” “our”) via https://www.centrefordigestivehealth.com. By signing up, paying for, or using any of our offerings, you (“Client,” “Member,” or “you”) agree to the following terms:
1. PROGRAMS AND SCOPE OF SERVICES
- Therapeutic Focus
We specialise in uncovering the root causes of a range of digestive and related systemic conditions—including but not limited to IBS (irritable bowel syndrome), SIBO (small intestinal bacterial overgrowth), GERD/reflux, and interconnected concerns such as autoimmune gut disorders, food sensitivities, skin issues, neural and hormonal imbalance, and metabolic health issues like weight or fatigue (Centre for Digestive Health). - Approach
Our method is grounded in functional medicine, focusing not just on managing symptoms but healing from the inside out—by restoring microbial balance, repairing your gut lining, calming inflammation, and supporting gut–brain–immune system harmony (Centre for Digestive Health). - Personalisation & Journey
Our work is deeply personalised. Whether you’re dealing with post-infectious IBS, chronic bloating, reflux, brain fog, mast cell issues, histamine intolerance, or other related symptoms—you’ll receive tailored assessment and support, conducted via live Zoom consultations for convenience and flexibility (Centre for Digestive Health). - Practitioner Team
Melinda King – Functional Medicine Practitioner (Institute of Functional Medicine); Nutritionist; Registered Counsellor (Australian Counselling Association); qualified SIBO treating Practitioner (The SIBO Doctor), gut microbiome restoration, and trauma-informed care (Centre for Digestive Health).
Dr Thim Yoon Chen – Qualified Medical Practitioner with background in general practice, dermatology, tropical medicine, travel medicine, occupational medicine, and clinical nutrition/metabolism which includes training with the Australian College of Nutritional and Environmental Medicine (Centre for Digestive Health).
2. FINANCIAL OBLIGATIONS
- Membership and Program fees are billed monthly or weekly, depending on the package you select. The structured “Journey” options begin with an Onboarding Visit, followed by ongoing follow-ups, with the cost smoothed over multiple payments (Centre for Digestive Health).
- You are responsible for fulfilling the full payment plan. Unpaid balances may result in suspension of access and recovery actions, including through a collection agency.
3. PAYMENT METHODS
- Our accepted methods of payment include Visa, Mastercard, and PayPal.
- Opting for instalment or recurring payment authorises us to charge your chosen payment method accordingly.
4. REFUNDS
- Refunds are discretionary and assessed individually.
- Accessing or downloading program materials does not guarantee you a refund—especially if the intent is to misuse or duplicate such content.
- Refunds will only be issued as required by Australian Consumer Law. For questions or claims, reach out to support@centrefordigestivehealth.com.
5. MEDICAL DISCLAIMERS & CLIENT RESPONSIBILITY
- Always seek clearance and ongoing care from qualified healthcare providers such as your GP, gastroenterologist, or other specialists before and during participation.
- You are fully responsible for your decisions and progress—and understand that results vary from person to person.
6. CONFIDENTIALITY & COMMUNITY USE
- The Members’ Portal is a supportive space—but you alone control what personal information you share.
- You agree to respect the privacy of other members and not disclose their personal or identifying information outside the community.
- All materials—including session recordings, workbooks, transcripts, group call content, and personal stories—are confidential, proprietary, and meant for your use only. Republishing, posting on social media, or unauthorized reuse is prohibited.
7. CONTENT AND INTELLECTUAL PROPERTY
- All materials provided remain the exclusive intellectual property of The Centre for Digestive Health.
- You are granted a single-user licence for personal use only.
- Reproduction, redistribution, repackaging, or repurposing of our content for sale or public distribution is strictly prohibited and may result in legal action.
8. AUTHORIZATION FOR RECORDINGS
- By participating in group calls, recorded workshops, or other shared sessions, you consent to potential audio/video capture and grant us permission to use such content for therapy, training, or promotional purposes—without further approval or compensation.
9. LIMITATION OF LIABILITY & INDEMNITY
- You participate at your own risk. The Centre for Digestive Health and its practitioners, staff, or affiliates are not liable for injuries, losses, or damages connected to your use of our services.
- You agree to indemnify and hold the Company harmless for any claims arising from your participation or breach of these Terms.
10. TERMINATION & RIGHT TO REFUSE ACCESS
- We reserve the right to terminate or suspend your access—for example, if you breach these Terms, act in a manner that harms community safety, or behave disruptively.
- If terminated, you remain responsible for any outstanding fees and for safeguarding the confidentiality of materials you accessed.
11. FORCE MAJEURE
- Our obligations may be delayed or suspended due to circumstances beyond our control (e.g., technical outages, natural disasters, or regulatory changes). We’re not held liable for such interruptions.
12. MODIFICATIONS TO TERMS
- These Terms may be updated at our discretion. Any changes will be posted on our website and take effect immediately.
13. DISPUTE RESOLUTION & GOVERNING LAW
- Should a dispute arise, both parties agree to resolve it in good faith. If unresolved, it will proceed to binding arbitration under Australian Centre for International Commercial Arbitration (ACICA) rules.
- This Agreement is governed by the laws of New South Wales, Australia.
14. ELECTRONIC AGREEMENT
- By signing up or using our services, you acknowledge and consent to these Terms. Your electronic enrolment constitutes a legally binding signature, and this Agreement is enforceable in full.
15. SERVICE CHANGES (UPGRADE OR DOWNGRADE)
- You may request an upgrade of your Service plan at any time. Upon such request we will apply the fee difference on a pro-rata basis for the remainder of the current billing period.
- If you request a downgrade of your Service plan, the downgrade will take effect at the start of the next billing cycle. Upon such request we will apply the fee difference on a pro-rata basis for the remainder of the current billing period. No refund or credit will be provided because of your decision to downgrade at a later time that would necessitate a refund to restore the balance to the new total downgraded price.
16. CANCELLATION AND MINIMUM COMMITMENT PERIOD
- All programs require a minimum commitment period of ninety (90) days from the date of enrolment (“Initial Term”).
- You may cancel your enrolment at any time. However cancellation will only take effect at the end of the Initial Term. If you cancel prior to the end of the Initial Term you remain responsible for payment of all Fees up to the end of that 90-day term, at the prices advertised on the website for the 3 month journey.
- After the Initial Term, you may cancel at any time by notifying us via email or through your account portal. The cancellation will take effect at the end of the current billing cycle, however you still remain responsible for payment of all Fees up to the end of that 90-day term, at the prices advertised on the website for the 3 month journey.
- Upon cancellation, you forfeit any access to services, community portal, materials, or bookings scheduled after the cancellation effective date. No refund or credit will be provided for unused portion of services after cancellation takes effect, except as required by law or where we explicitly decide otherwise.
17. EFFECT OF CANCELLATION OR DOWNGRADE ON ACCESS AND MATERIALS
- If you downgrade or cancel, any scheduled services, appointments, or access to the members’ portal beyond the effective date of downgrade/cancellation will be void.
- You acknowledge that in downgrading or cancelling, you may lose access to certain materials, content, or features that were part of the higher-tier plan, and no liability is accepted for loss of those benefits.
18. PAYMENT OBLIGATION ON EARLY CANCELLATION
- Early cancellation within the ninety (90) day minimum commits you to continued payment until the end of that term, at the prices advertised on the website for the 3 month journey - regardless of whether you use further services.
- Any outstanding payments due at the time of cancellation remain payable and may be subject to recovery actions.
19. AMENDMENTS TO SERVICE FEES AND TERMS RELATED TO UPGRADES/DOWNGRADES
- Any change to service fees or structure will be communicated to you at least thirty (30) days before taking effect.
- You may accept or decline such changes; if you decline and wish to cancel, the cancellation will follow the rules above.
